A decis\u00e3o \u00e9 definitiva.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As desaven\u00e7as entre as duas mulheres, uma vendedora e uma auxiliar de servi\u00e7os gerais, ocorreram por ci\u00fames, devido ao envolvimento da primeira com o ex-companheiro da outra. Na \u00e9poca, o casal j\u00e1 estava separado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A vendedora se sentiu ofendida com uma postagem em que sua imagem era depreciada e na qual ela era apontada como algu\u00e9m que se interessava por homens casados. Na a\u00e7\u00e3o, ela solicitou, liminarmente, a retirada das fotos e textos ofensivos e indeniza\u00e7\u00e3o por danos morais. A autora dos&nbsp;<em>posts&nbsp;<\/em>reconheceu que errou ao publicar o conte\u00fado danoso, mas alegou que estava sob violenta emo\u00e7\u00e3o e que exerceu seu direito de opini\u00e3o e liberdade de express\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O juiz Adalberto Cabral da Cunha entendeu que houve dano \u00e0 honra e fixou o valor da indeniza\u00e7\u00e3o. Ele avaliou que as express\u00f5es utilizadas trouxeram constrangimento e feriram a reputa\u00e7\u00e3o, a dignidade e o decoro da vendedora. Para o magistrado, o texto demonstra que houve inten\u00e7\u00e3o de divulgar mensagens difamat\u00f3rias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Al\u00e9m disso, a pr\u00f3pria r\u00e9 admitiu ter praticado atitude il\u00edcita, mas tentou justificar-se afirmando que seu estado emocional foi abalado pela separa\u00e7\u00e3o. O juiz confirmou a determina\u00e7\u00e3o de retirada dos&nbsp;<em>posts&nbsp;<\/em>e fotos do ar e a proibi\u00e7\u00e3o de a usu\u00e1ria incluir a v\u00edtima em novas publica\u00e7\u00f5es, j\u00e1 concedida em antecipa\u00e7\u00e3o de tutela, e arbitrou a indeniza\u00e7\u00e3o por danos morais de R$ 3 mil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ambas as partes recorreram ao Tribunal. A auxiliar de servi\u00e7os gerais argumentou que o epis\u00f3dio n\u00e3o era capaz de causar abalo \u00e0 esfera \u00edntima. A vendedora requereu o aumento do valor a receber. O relator da apela\u00e7\u00e3o, desembargador Marco Aurelio Ferenzini, manteve o entendimento de primeira inst\u00e2ncia, pois, segundo o magistrado, ficaram evidentes os danos sofridos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ele considerou, ainda, que o valor fixado pelo juiz cumpre com razoabilidade a fun\u00e7\u00e3o da indeniza\u00e7\u00e3o por\u00a0dano moral, qual seja, n\u00e3o ser fonte de enriquecimento il\u00edcito da v\u00edtima, mas tamb\u00e9m coibir a repeti\u00e7\u00e3o da pr\u00e1tica.
