A autora do processo alegou que o corpo, ao chegar ao vel\u00f3rio, exalava mau cheiro e secre\u00e7\u00f5es pelos olhos, nariz e ouvidos.<\/p>\n<p>Houve pedido para corre\u00e7\u00e3o de eventuais falhas no embalsamento, contudo, o corpo retornou ao local do vel\u00f3rio com os mesmos problemas e, por isso, foi necess\u00e1rio o sepultamento imediato, sem a presen\u00e7a de todos os familiares que residiam em cidades distantes de Malacacheta.<\/p>\n<p>Os representantes da funer\u00e1ria disseram que houve uma rea\u00e7\u00e3o al\u00e9rgica do corpo aos produtos utilizados para o embalsamento. Sustentaram que n\u00e3o possuem a obriga\u00e7\u00e3o de reparar os danos morais reclamados e que, mesmo com o atraso, todos os servi\u00e7os contratados foram prestados.<\/p>\n<p>A decis\u00e3o do juiz Renzzo Giaccomo Ronchi, da comarca de Malacacheta, foi confirmada pela 13\u00aa C\u00e2mara C\u00edvel do Tribunal de Justi\u00e7a de Minas Gerais. O relator do recurso no TJMG, desembargador Luiz Carlos Gomes da Mata, entendeu como correta a fixa\u00e7\u00e3o de uma indeniza\u00e7\u00e3o por dano moral.
