O pol\u00edtico teve os direitos pol\u00edticos suspensos por cinco anos e dever\u00e1 pagar multa correspondente a cinco vezes sua remunera\u00e7\u00e3o. A 2\u00aa C\u00e2mara C\u00edvel do Tribunal de Justi\u00e7a de Minas Gerais (TJMG) manteve a decis\u00e3o do juiz Rodrigo Lage, da 1\u00aa Vara C\u00edvel de Tim\u00f3teo (Vale do A\u00e7o).<\/p>\n<p>O Minist\u00e9rio P\u00fablico de Minas Gerais (MPMG) ajuizou a\u00e7\u00e3o civil p\u00fablica contra S\u00e9rgio Mendes Pires por improbidade administrativa. Segundo a den\u00fancia, em 2012, o ent\u00e3o prefeito antecipou para si, o vice e os secret\u00e1rios sal\u00e1rios e gratifica\u00e7\u00f5es natalinas, enquanto o restante dos servidores teve seus proventos pagos, de forma parcelada, apenas na gest\u00e3o seguinte, em 2013.<\/p>\n<p>O pol\u00edtico apresentou contesta\u00e7\u00e3o negando que sua conduta representasse improbidade, pois, segundo ele, todos receberam seus sal\u00e1rios nas datas previstas.<\/p>\n<p>Na senten\u00e7a, o juiz Rodrigo Lage condenou o ex-prefeito \u00e0 pena de multa, suspendeu os direitos pol\u00edticos dele e o proibiu de contratar com o poder p\u00fablico ou receber benef\u00edcios ou incentivos fiscais ou credit\u00edcios, direta ou indiretamente, ainda que por interm\u00e9dio de pessoa jur\u00eddica da qual seja s\u00f3cio majorit\u00e1rio, pelo prazo de tr\u00eas anos.  <\/p>\n<p>O ex-prefeito recorreu, argumentando que n\u00e3o houve ofensa a qualquer princ\u00edpio da administra\u00e7\u00e3o p\u00fablica. Ele pleiteou que n\u00e3o fosse aplicada a Lei de Improbidade Administrativa.<\/p>\n<p>Os magistrados aceitaram em parte o pedido do r\u00e9u, apenas para afastar a proibi\u00e7\u00e3o de contratar com a administra\u00e7\u00e3o p\u00fablica ou receber benef\u00edcios ou incentivos fiscais ou credit\u00edcios, mantendo as demais penalidades fixadas na senten\u00e7a. <\/p>\n<p><strong>Diverg\u00eancia<\/strong><\/p>\n<p>A turma julgadora, formada pelos desembargadores Caetano Levi, Afr\u00e2nio Vilella e Marcelo Rodrigues, divergiu em rela\u00e7\u00e3o a diversos argumentos de defesa. Por isso, os demais componentes da c\u00e2mara, desembargadores Raimundo Messias J\u00fanior e Hilda Teixeira da Costa, participaram do julgamento. Por maioria, os magistrados mantiveram a condena\u00e7\u00e3o \u00e0 multa e \u00e0 suspens\u00e3o dos direitos pol\u00edticos.<\/p>\n<p>Prevaleceu o entendimento expresso no voto do desembargador Raimundo Messias. Segundo o magistrado, o pol\u00edtico agiu de m\u00e1-f\u00e9, ofendendo os princ\u00edpios da legalidade e da moralidade.
